Terms & Conditions
1. Introduction
1.1. These Terms and Conditions (“Terms”) apply to all swimming lessons, courses and related services (“Lessons”) provided by Aquilla Health Club (“Aquilla”, “Aquilla Swim Club”,” Swim Club”, “we”, “us”, “our”) to you (“you”, “your”, “parent/guardian”, “student”).
1.2. By booking and/or attending any Lesson, you confirm that you have read, understood and agree to be bound by these Terms and by any additional rules displayed at the Club or on our website.
1.3. Where a student is under 18, “you” includes the student’s parent or legal guardian, who enters into this agreement on the student’s behalf and is responsible for compliance with these Terms.
2. Use of Facilities
2.1 Club Rules, Access and Conduct
2.1.1 Safety, Conduct and Facility Use
By attending Swim Club Lessons, you and your child must comply with all applicable Aquilla Health Club rules relating to safety, hygiene, supervision, access control, and conduct as they apply to Swim Club students and their accompanying adults.
- Swim Club students are not Club members and are not subject to membership-only obligations. References to “Club rules” are limited to those relevant to Swim Club use of the premises.
- Use of facilities is at your own risk. You must not act in a way that puts yourself, other students, staff, or visitors at risk. Follow all instructions from Aquilla staff, including emergency and evacuation procedures.
- Conduct must be orderly, courteous, and non-disruptive. Any damage caused to Club property due to negligence or misconduct must be paid for. Smoking and the use of drugs or alcohol on the premises are strictly prohibited.
2.1.2 Access Control and Swim Club Access Credentials
- Aquilla may require Swim Club students and/or accompanying adults to use a Swim Club-specific access card, wristband, digital pass, or other access method for entry, monitoring, or safeguarding purposes.
- Access credentials do not confer Club membership or access to member-only facilities.
- Credentials must be used as instructed on each visit.
- Aquilla reserves the right to refuse entry or withdraw access where credentials are not produced, are misused, or are shared.
2.1.3 Facility Access and Restrictions
2.1.3.1 Permitted Areas
Swim Club students and accompanying adults may only access:
- The swimming pool (strictly for the duration of the Lesson);
- Designated reception and waiting areas;
- Designated family changing facilities above the pool;
- Toilets specifically allocated for Swim Club use.
2.1.3.2 Restricted Areas
Students and accompanying adults are not permitted to access any other Club facilities, including but not limited to:
- Gym or fitness areas;
- Steam room or sauna;
- Hot tub;
- Studios or studio classes;
- Spa, treatment, or relaxation areas; or
- Any other member-only facilities.
2.1.3.3 Enforcement
Breach of these access rules may result in refusal of entry, suspension, or termination of Lessons without refund.
2.1.4 Supervision
- Except during supervised Lessons, Club facilities are not continuously manned.
- Students may only use the swimming pool during their booked Lesson and under instructor supervision.
- Parents/guardians and accompanying adults are responsible for ensuring that they and their child do not act in a way that places themselves, others, or staff at risk.
2.1.5 CCTV
CCTV surveillance operates in the swimming pool, entry and exit points, and other non-private areas (excluding changing rooms and toilets) for safety, security, and operational purposes.
2.1.6 Operational Changes
Aquilla reserves the right to change instructors, class timetables, pool lanes, or Lesson formats at any time where reasonably necessary (including due to staff illness, operational requirements, or safety considerations).
2.1.7 Refusal of Entry, Suspension, and Termination
Aquilla reserves the right to refuse entry, suspend, or terminate Lessons (without refund) if conduct, in our reasonable opinion, is:
- Unsafe or likely to place others at risk;
- Abusive, discriminatory, threatening, or seriously disruptive;
- Damaging or potentially damaging to staff, other customers, or facilities; or
- In breach of these Terms, applicable Club rules, or access control requirements.
2.2 Arrival and Access
2.2.1 Timing
- Arrive no more than 15 minutes before the Lesson.
- Arrive in sufficient time to be changed and ready to enter the pool at the start.
2.2.2 Late Arrivals
- Late arrivals may be refused entry or have participation limited for safety or to prevent disruption.
- No refund or make-up Lesson will be given for lateness or missed Lessons.
2.2.3 Entry and Exit
- Entry is permitted only via the main entrance.
- Emergency exits are for emergency use only.
- Students must exit the pool immediately at the end of their Lesson and leave the Club no later than 30 minutes after the Lesson finishes.
2.2.4 One Adult per Swimmer
- Only one parent/guardian per swimmer may enter at a time, unless additional carers are agreed in advance for accessibility or medical reasons.
- Additional spectators or family members may be refused entry.
2.2.5 Pool Access Duration
- Students may only be in the pool during their booked Lesson under instructor supervision.
- Access before or after the Lesson is not allowed.
- Hot tub use is never allowed for Swim Club students.
2.3 Swimwear, Showers, Towels, and Equipment
2.3.1 Swimwear
- Appropriate swimwear must be worn at all times in the pool.
- No denim, underwear, or street clothes permitted.
- Pool entry may be refused if clothing is unsafe, unhygienic, or inappropriate.
2.3.2 Hygiene
- All swimmers must shower before entering the pool.
- Children not fully toilet-trained must follow the current swim nappy policy.
2.3.3 Towels and Personal Items
- One towel per swimmer per Lesson is provided. Towels remain Club property and must be returned.
- Lost or damaged towels: £20 replacement cost.
- Jewellery or accessories that may cause injury or damage must not be worn in the pool.
2.4 Food, Drink, and No Glass Policy
2.4.1 Glass
- No glass (bottles, jars, cosmetics) permitted anywhere on the premises.
2.4.2 Safety and Hygiene
- No crockery or breakable containers on poolside, changing rooms, or in the pool.
- No food or drink other than water on poolside or in changing rooms within 1 hour before Lessons.
2.4.3 Pre-Lesson Meals
- Swimmers are advised not to consume any meal within one hour of swimming.
2.5 Buggies, Prams, Scooters, and Personal Items
- Must be stored in designated buggy area only.
- Not permitted in corridors, changing rooms, or poolside.
- Swim Club accepts no responsibility for loss, theft, or damage.
- Electric Buggies, Prams, Scooters are not permitted on premises
2.6 Changing Facilities and Family Area
2.6.1 Children’s Changing Facilities
- Participants under 16 must use designated family changing facilities above the pool.
- Men’s or women’s changing rooms are not permitted for under 16s.
2.6.2 Family Changing Area
- All-gender facility with individual cubicles for privacy.
2.6.3 Cubicles and Lockers
- Cubicles are for changing only.
- Clothes and belongings must be stored in provided lockers.
- Items left in cubicles may be removed for safety or access reasons.
- Swim Club accepts no responsibility for loss, theft or damage.
2.7 Changes to Terms and Conditions
- Aquilla reserves the right to amend, update, or replace these Terms with 14 days written notice.
- Changes become effective 14 days after written notice.
- Continued participation after the effective date constitutes acceptance of the updated Terms.
3. Health, Fitness and Safety
3.1. If you have any doubts about your or your child’s fitness or ability to participate in swimming activities, you must seek medical advice before attending.
3.2. By attending Lessons, you confirm that:
- you (or your child) are in a suitable physical condition to participate safely; and
- you have disclosed all relevant medical, behavioural or additional needs information and will keep this information up to date with Aquilla.
3.3. If you (or your child) are pregnant, have recently undergone surgery, or have any illness, condition, injury or disability that could affect safe participation, you must seek advice from a doctor and follow that advice.
3.4. You must not use the pool or facilities if you (or your child) are suffering from:
- any infectious or contagious disease or illness;
- open cuts, sores, abrasions or serious skin complaints; or
- any condition that may pose a risk to others’ health, safety or comfort.
3.5. You should familiarise yourself with fire exits and emergency procedures. In the event of an emergency, you must follow staff instructions and evacuate promptly via the nearest safe exit.
4. Lockers, Personal Belongings and Lost Property
4.1. For security reasons, you are strongly advised to store all personal belongings in lockers provided while using the facilities.
4.2. Lockers are for day use only. Items left overnight will be removed and treated as lost property.
4.3. Aquilla will not accept liability for any loss of or damage to personal property brought into or left on the premises, whether in lockers, buggy areas or elsewhere.
4.4. All lost property should be handed to a member of staff. Items whose owner cannot be identified will normally be held for up to 2 weeks, after which they may be donated to charity or disposed of. Wet or soiled items will be disposed of sooner, typically within 12 hours.
5. Behaviour, Supervision and Poolside Etiquette
5.1. Abusive language, threatening behaviour, bullying or any form of discrimination will not be tolerated and will result in immediate termination of Lessons without refund.
5.2. We reserve the right to refuse entry, suspend or terminate membership and/or Lessons without refund if your behaviour (or that of your child or guests) is unsafe, disruptive, or in serious breach of these Terms or Club rules.
5.3. Parents/guardians must remain on the premises for the entire duration of children’s Lessons.
- Children aged 16 and under must always have a responsible adult in the building while attending Lessons.
- Children must be collected promptly at the end of the Lesson.
5.4. Children must be supervised by their parent/guardian at all times when not in their Lesson, including in reception, changing areas and any waiting areas.
5.5. Seating, walkways and emergency routes
- Chairs and other seating provided by the Club must remain in the designated seating/viewing areas.
- You must not move chairs or other seating from these areas, and all gangways, poolside routes and emergency exits must remain clear at all times.
- If chairs or other items are moved in a way that blocks views, walkways or access routes, staff may require you to return them to the designated area.
- Persistent failure to comply may result in your access being restricted or your Lessons being terminated, without refund.
6. Photography, Filming and Mobile Devices
6.1. No photography or filming is permitted in the pool area, changing rooms or any other club`s premisses.
6.2. Mobile phones and other devices must not be used in any way that compromises the privacy, safety or comfort of other users.
6.3. On rare occasions Aquilla may arrange photography or filming for training or promotional purposes. Where individuals are identifiable, appropriate prior consent will be obtained.
7. Lesson Types, Bookings and Payments
7.1. Lesson formats
Aquilla offers the following Lesson package options, in 1:1 (onetoone); 2:1 (twotoone) or parent and baby class setups:
- Termly Lessons – structured courses aligned with school terms and school holidays.
- Oneoff Lessons – single standalone private or semiprivate sessions.
- Crash Courses – short intensive courses (e.g. during school holidays).
7.2. Current prices for all Lesson packages are available from reception, on our website or via our booking platform.
7.3. Bookings are not confirmed until full payment has been received and processed. You will receive booking confirmation in writing (e.g. email).
7.4. Termly bookings are payable in full at the time of booking (or by the advertised due date). Oneoff Lessons and Crash Courses must be paid in full at the time of booking.
7.5. You are responsible for ensuring payment details are correct and that funds are available on the due date.
7.6 Changes to Prices
7.6.1. We reserve the right to change our prices at any time.
7.6.2. The price for any new booking is the price shown at the time you complete that booking.
7.6.3. For future terms or repeat bookings, any price changes will apply from the next term or package purchased. We will use reasonable endeavours to communicate price changes in advance but are not obliged to maintain any particular price for any fixed period.
8. CoolingOff Period and Cancellation by You
8.1 Statutory 14Day CoolingOff Period
8.1.1. If you are a consumer booking online, by phone or by email, you have a legal right under the Consumer Contracts Regulations 2013 to cancel your booking within 14 days from the date it is confirmed (the “CoolingOff Period”).
8.1.2. If you cancel within the CoolingOff Period:
- you will receive a refund of monies paid;
- we will deduct the value of any Lessons already taken at the full current standard Lesson rate; and
- we will apply an administration fee of 10% plus VAT of the paid amount
(E.g. if £50 plus VAT has been paid, we will charge £5 plus VAT as the admin fee).
8.2 After the CoolingOff Period
8.2.1. After the 14day CoolingOff Period, no refunds will be given for any Lessons, including:
- unused Lessons in a termly booking;
- missed or unattended oneoff Lessons;
- missed or unattended Crash Course sessions.
8.2.2. You may notify us that you wish to stop attending future Lessons within a term; however, payments already made are nonrefundable and nontransferable.
9. Cancellations, Rescheduling and MakeUp Lessons
9.1 Swim Club Cancellations and Rescheduling
9.1.1. We may cancel or reschedule any Lesson at any time for any reason, including (but not limited to) instructor illness, pool issues, maintenance, safety concerns or events outside our reasonable control.
9.1.2. If we cancel a Lesson, you will be offered a rescheduled Lesson.
9.1.3. Affected Lessons will be rescheduled and must be taken within 30 days of the original Lesson date. No cash refunds or account credits will be issued for rescheduled Lessons.
9.1.4. No cash refunds will be given for Club`s cancellations except in exceptional circumstances at our discretion.
9.2 MakeUp Lessons
9.2.1. Makeup Lessons will only be given where a Lesson did not take place because the Swim Club cancelled it.
9.2.2. There are no makeup Lessons, credits or refunds for Lessons missed or not attended by you (for any reason, including illness, holidays, conflicting activities or travel difficulties).
10. Liability
10.1. All swimming and use of the Club’s facilities are undertaken at your own risk (or at your child’s own risk, for whom you are responsible), except where the law provides otherwise.
10.2. Aquilla, its staff and instructors shall not be liable for any injury, loss or damage except were caused by our proven negligence.
10.3. To the fullest extent permitted by law, we are not liable for:
- any loss of or damage to personal property brought into or left at the Club; or
- any indirect or consequential loss (such as travel costs, loss of earnings or other expenses) arising from cancelled or rescheduled Lessons.
10.4. You must report any accident, injury or incident occurring on the premises to a member of staff as soon as reasonably possible and complete any required accident/incident report forms.
11. Data Protection and Communications
11.1. We process personal data in accordance with applicable data protection law (including the UK GDPR and the Data Protection Act 2018).
11.2. Your personal information will be used to:
- manage your booking and account;
- deliver Lessons and associated services;
- send you servicerelated and, where you consent, marketing communications.
11.3. We will not sell your details to third parties. We may share data with trusted service providers (e.g. booking and payment processors) who act on our instructions and are bound by appropriate data protection obligations.
11.4. You may update your details or request changes to your marketing preferences at any time by contacting us using the details on our website or in your booking confirmation or swimaquilla@sarova.com.
12. Changes to These Terms
12.1. We may amend these Terms from time to time to reflect changes in law, best practice or our operational requirements.
12.2. Updated Terms will be published on our website and/or made available at reception. Where changes materially affect existing customers, we will use reasonable endeavours to notify you.
12.3. Your continued use of our services after the effective date of updated Terms will constitute your acceptance of those changes.
13. Governing Law and Jurisdiction
13.1. These Terms, and any dispute or claim arising out of or in connection with them, are governed by and construed in accordance with the laws of England and Wales, unless otherwise stated.
13.2. You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
